Service.

This document governs the contractual relationship between Kurivost and its clients, defining the operational boundaries of our omnichannel messaging solutions.

Acceptance of Terms

By accessing or using the services provided by Kurivost, located at 123 Market Street, San Francisco, CA 94103, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease all use of our platform and messaging consultancy services.

These terms represent a legally binding agreement between you—whether personally or on behalf of an entity—and Kurivost. We reserve the right to change or modify these terms at any time. Your continued use of the site following any updates constitutes acceptance of the new terms.

Service Scope and Deliverables

Kurivost provides high-performance, omnichannel marketing solutions focusing on high-volume messaging across SMS, Email, and Social platforms. Our service scope includes strategy development, technical implementation, and compliance monitoring for global enterprises.

  • Channel Integration: Provisioning and management of API endpoints for message delivery.
  • Strategic Consultancy: Guidance on frequency, content optimization, and audience segmentation.
  • Data Analytics: Real-time reporting on delivery rates, engagement metrics, and conversion data.

User Conduct and Anti-Spam Policy

As a premium marketing service provider, we maintain a zero-tolerance policy regarding illegal or unethical messaging practices. Users are prohibited from using our infrastructure to transmit:

Unsolicited Content

Messages sent without explicit, verifiable consent from the recipient.

Deceptive Practices

Misrepresenting the identity of the sender or the purpose of the communication.

Failure to comply with these conduct standards will result in immediate suspension of account access and may lead to legal action to protect the integrity of our network.

Limitation of Liability

To the maximum extent permitted by applicable law, Kurivost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or other intangible losses resulting from your access to or use of our services.

We do not warrant that our messaging channels will be uninterrupted or error-free at all times, as delivery depends on third-party carrier networks. Our total liability for any claim under these terms is limited to the amount paid to us for the specific service period giving rise to the claim.

Global Compliance

Operations at Kurivost are conducted in strict accordance with international regulations, including but not limited to GDPR (Europe), TCPA (USA), and CASL (Canada). It is the client's sole responsibility to ensure that their database hygiene and consent records meet the specific legal requirements of the regions in which they operate.

By utilizing our platform, you indemnify Kurivost against any claims arising from a breach of local telecommunications or privacy laws resulting from your messaging campaigns.

Managed Service

Full-throttle messaging execution where Kurivost handles technical delivery, creative A/B testing, and daily compliance rotation.

Enterprise API

High-volume dedicated routes for businesses requiring direct bridge access to global carrier networks.

Agreement
Termination.

Either party may terminate the service agreement with thirty (30) days' written notice. Kurivost reserves the right to terminate access immediately if a user is found to be in violation of our Anti-Spam Policy or Conduct Guidelines.

Upon termination, all outstanding fees become immediately due, and your right to use our proprietary messaging protocols will expire.
